TERMS AND CONDITIONS

The following are Nova Driving School’s (“NDS,” “Nova”) General Terms and Conditions. These terms and conditions apply to all students in all classes. This agreement constitutes all policies agreed upon by registered NDS students. Please read this page carefully.

 

COVID-19 PRECAUTIONS: Nova Driving School is committed to the safety and well-being of its students and staff. The following conditions are in place until further notice:

 
  • - Nova instructors will be required to wear masks during classes/driving lessons. Students visiting the office, or who are engaged in Behind-The-Wheel/classroom lessons, must wear masks, until such a time that Nova's policy on mask usage changes and is reflected on our Terms and Conditions forms and website.
  • - Eating/drinking is prohibited on-location and in a Nova Driving School vehicle.
  • - Students are highly encouraged to cancel lessons in advance if they are symptomatic (persistent cough, fever, etc,.), or if they have come into contact with symptomatic people/positive COVID-19 cases. These students are encouraged to schedule their lessons at least 14 days after the point of contact.
  • - If a student needs to cancel last-minute due to a positive COVID-19 case, the cancellation fee may, at NDS’ discretion, be waived if a copy of a positive test result is submitted to NDS. A negative test result must then be submitted prior to rescheduling lessons.
  • - NDS may, at the direction of the State, cancel all upcoming driving lessons, in accordance to the State of Illinois' Restore Illinois/COVID-19 policies.
 

INTELLECTUAL PROPERTY: All techniques and materials are the exclusive property of Nova Driving School (“NDS”). You agree not to disclose, sell or distribute any information, written or spoken, obtained from NDS, to any third party.

 

STUDENT DISMISSAL AND SCHEDULING: NDS may, at its own discretion, change course schedules and locations and, on rare occasions, cancel a course if there is not a minimum of 7 students enrolled. In the case of Motorcycle Programs, Riding Practice and Road Test can also get cancelled due to weather conditions. You understand that course size is limited and therefore enrollment is taken on a first-come, first-serve basis. NDS may dismiss any student who has not paid tuition, in full, in accordance with our tuition policies or who, in NDS’s opinion, has a disruptive attitude or smell during classroom and/or driving lessons, or refuses to comply with in-class/in-car conduct policies. .

 

CONFIDENTIALITY: NDS will not disclose, sell, or distribute any information obtained from a student, either written or spoken, with any third party, unless it is requested to do so by legal party or court order. The student agrees not to copy, reproduce, download, upload, post, display, broadcast, transmit, distribute, publish, republish, encode, translate or otherwise use any Materials or Marks provided on this website in any form, by any means, in any medium, or by any information storage or retrieval system without the express written permission of NDS.

 

WEBSITE: Both NovaDrivingSchool.com and NovaDriving.com make use of marketing pixels. All trademarks, service marks, logos, model and brand names, emblems and protectable trade dress elements, whether explicitly marked or not, (individually and collectively, “Marks”) used on this website are owned by NDS or joint partners, or are used with permission. All Marks are subject to U.S. (federal and state) and international trademark, unfair competition laws, and other intellectual property laws.

 

PERSONAL PROPERTY: The staff and instructors at Nova Driving School are not liable for loss of a student’s private property and/or documents. Please keep track of your belongings when in a Nova classroom or car.

 

DISPUTE RESOLUTION: All disputes under Administrative Driving Code, Title 92, Chap. II, Part 1060.80 shall be directed to the Illinois Secretary of State Office.

INSTRUCTION PERMIT: Students must have a valid driver’s instruction permit with them any time they intend to drive a vehicle. If a student does not have their permit with them on a lesson day, the lesson will be cancelled and a $60 rescheduling fee will apply.

 

FOOTWEAR POLICY: Students may not wear sandals, Crocs, or open-toed shoes of any kind during driving lessons. Shoes must cover both the toes and the heels of the student. No high heels of any kind are permitted during Behind-the-Wheel lessons. If the student fails to meet these requirements, the lesson(s) will be recorded as cancelled, and a $60 cancellation fee will be incurred.

 

CELL PHONES/ELECTRONIC DEVICES: Use of cell phones and/or any other portable electronic devices by students during BTW lessons is strictly prohibited. Students are asked to silence/turn off their cell phone and/or any other portable electronic devices during driving lessons. Students who do not follow these guidelines will be excused from the lesson and will not receive an attendance credit for the lesson.

 

PARALLEL PARKING AND HIGHWAY DRIVING: Please note that these skills are taught at the instructor’s discretion and are not guaranteed to be included in Behind-the-Wheel lessons unless the student has purchased either the Ultimate Beginner package (adults) or an additional two-hour lesson for parallel parking and highway driving (teens).

 

TEEN DOCUMENTS: All registration documents must be turned in to NDS before any teen can begin their Behind-the-Wheel lessons.

 

CANCELLATION NOTICE FOR DRIVING: All cancellations of driving lessons must be made at least 24 hours in advance of the lesson’s start time. Students who do not cancel their lessons at least 24 hours in advance will be charged a $60 cancellation fee per every two hours scheduled. Cancellations can be made via the student’s Nova web portal account (for which all students receive a login and password when they first sign up for classes with Nova), or by speaking directly to a member of the office on the phone. Text messages, emails, or voicemails left for Nova staff are not sufficient notice, and are not accepted as cancellation notifications.All canceled lessons must be rescheduled for the student to complete the required driving time mandated by Secretary of State.

 

IN-LESSON CANCELLATION: BTW lessons begin when the instructor arrives at the location of the lesson at the scheduled time. The instructor reserves the right to cancel the lesson at any time if they are concerned that the student is in any way impaired. A lesson may also be cancelled if the student chooses not to take the lesson, is not wearing adequate footwear, or if the student refuses to follow the instructor’s directions (especially and including warnings about a student’s reckless behavior.) Nova’s obligations to the student for that lesson shall be considered fulfilled if it is cancelled under any of these conditions.

If the instructor decides to stop a lesson while it is in progress due to lack of adequate footwear, the student’s cognitive impairment, or failure to follow directions, Nova will consider that lesson as fulfilled. The student will not owe a cancellation fee, but will not receive a refund for the lesson. Credit for driving lessons is valid for nine months from the purchase date. If a full year passes before the student makes up the lesson, they will have to pay full price for any additional driving lessons.

All canceled lessons must be rescheduled for the student to complete the required driving time mandated by the Secretary of State.

 

TRANSPORTATION TO THE ROAD TEST: While BTW instruction is private, if a student chooses to go to their Road Test with no lesson attached, they may be scheduled to ride with an instructor who is going to the Secretary of State with another student. Nova will provide home pick-up on the day of the Road Test only if it is combined with a lesson. If a student will travel on their own to the SOS office, they will be given a time to meet a Nova instructor at the SOS office or at the public transportation station nearest to the SOS.

 

ROAD TEST AT SECRETARY OF STATE’S OFFICE: Two hours are allotted for the road test. Any additional time spent at the Secretary of State due to delays in line or other factors, including the need to resolve documentation, eligibility, or license issues will be charged at a rate of $50/hour. Upon departure from the Secretary of State, students can choose to be dropped off at the nearest CTA transportation station, rather than at their home, if they wish to avoid incurring the $50/hour charge if the total time spent for the road test exceeds two hours. Students can choose to reschedule the road test for another day in order to resolve any issues preventing them from taking the test, but they will owe Nova a $60 rescheduling fee.

 

NOT READY FOR ROAD TEST: If the instructor feels that you are not ready for the Road Test (RT), they will cancel the test and you can use those 2 hours as a regular lesson or you can cancel it 1, with a $60 fee and rescheduled it for a different day.

 

VALIDITY AND TRANSFER: NDS Students will have nine months from the start of their program to complete all purchased hours. After these nine months, the credit will expire and students will have to re-register and begin the program again. These nine months begin from the first day of service. For Classroom students, this begins on the first day of class. For Behind-The-Wheel students, this begins on the day of purchase.

After this 9-month period, the credit will expire. This credit is transferable to other students before it expires. If for any reason, a teen student is dropped from a class and needs to re-enroll in another one, there is a $45 re-enrollment fee, if the teen is re-enrolled before the credit expiry date.

 

REFUNDS AND OTHER FEES: If for any reason you need a refund, a 30% processing fee will be assessed to the amount refunded. Refunds are only distributed to those with credit less than 30 days old. All debit/credit payment transactions are also subject to a 3% processing fe

 

PAYMENT REFUSAL/LACK OF FUNDS: In the event that the method of payment is returned for insufficient funds, the student or parent(s) will be responsible for the entire balance, as well as for any bank fees incurred by NDS due to payment refusal. In the event that the balance is not paid in full by 90 days, the student or parent(s) will be responsible for all billed charges, collection costs, and reasonable attorney fees.

 

TEEN CERTIFICATION/ELIGIBILITY: To be eligible to earn their driver’s license before they turn 18, teens residing in Illinois must complete a 30-hour classroom course as well as a minimum six-hour Behind-the-Wheel course. Teens may be eligible for classroom instruction if the class program ends after the student turns 15 years of age.

Students will be eligible to take the Illinois Written Exam to obtain their Illinois Class D Permit after the fourth day of class. The following documents must be turned in before the conclusion of a complete program, or certification will not be sent to the Secretary of State:

Behind-The-Wheel Only students (BTW-Only) will, in addition to the above documents, also need to provide proof of completion of the classroom portion of Driver's Ed, or certification will not be sent to the Secretary of State. If the students are interested in the Teen Road Evaluation, this proof must also show a letter grade of A or B.

After completion of their Behind-The-Wheel program, students must wait for a certificate from the Secretary of State, sent via postage mail, before they may visit the DMV to take their road test (provided that they are eligible to obtain their Class D license, as detailed below).

Nova Driving School applies to the Secretary of State for the teen to receive full certification for completing Driver’s Ed when the following criteria have been met:

  1. 1. The teen has completed all required classroom and in-vehicle training.
  2. 2. All required documents are submitted to Nova Driving.

To obtain a Class D Illinois Driver’s License, a teen must meet the previous two criteria, in addition to:

  • - be at least 16 years of age
  • - have held an Instruction Permit for at least 9 months
  • - has fulfilled the 50-hour log sheet with at least 50 hours of Behind-The-Wheel practice recorded.
 

TEEN ABSENCE/MAKEUP POLICY: A maximum of four absences are allowed throughout the teen classroom program. Students who arrive more than 15 minutes late after class start can be marked as absent, at instructor discretion. Missed classes or missing/failed classwork must be made up before the conclusion of the program – makeup sessions are held at Nova locations every Friday, anytime between 3:30p-5:30p, unless otherwise stated or arranged. Missing the fifth class will result in the student being dropped from the program. The student may re-enroll in another class for a $45 re-enrollment fee, provided that credit is still valid. Note that academic dishonesty/cheating on chapter work will result in the student’s work not counting, and an absence being marked, at the discretion of the instructor. Repeated cases of cheating can lead to, at the discretion of NDS, removal from the program. The student may re-enroll in another class for a $45 re-enrollment fee, provided that credit is still valid.

 

INDEPENDENT CLASSROOM SESSIONS: Must be canceled at least 48 hours in advance via phone call only (no emails/voicemails). Last-minute cancellations or no-shows for Independent classroom sessions are subject to a $90/2 hours fee.

 

STUDENT CONDUCT: The instructor reserves the right to cancel a lesson or remove a student from class, if a student fails to follow our Behind-The-Wheel and classroom policies, including but not limited to: not carrying an Instruction Permit, not wearing proper closed-toe footwear, hygeine, COVID-19 precautions, misconduct or improper behavior.

 

TEEN SCHEDULING BEHIND-THE-WHEEL (BTW) LESSONS: Your teen may start their BTW Lessons as long as their program is paid in full, and completed copies of the Instruction Permit, School Approval Form, and this Agreement form turned in to the Nova office. BTW Lessons will not be scheduled until all the above criteria is met. Note that for BTW-only students, proof of classroom driver’s ed completion is also required.

 

TEEN ROAD EVALUATION POLICY: Students who have completed the classroom and range requirements for Driver's Ed, with a final classroom grade of B or higher, qualify for taking a Road Evaluation at Nova. If you have completed Driver's Education elsewhere, a copy of the permit and proof of classroom completion (with letter grade) is required to register for the Teen Road Evaluation.   Students who pass the evaluation at Nova are issued a certificate that they may use, after fulfilling the time and 50-hour requirements, at the DMV to obtain their Driver's License. The certificate replaces the need for taking the test again at the DMV. Students who undertake the Teen Road Evaluation at Nova are subject to a spot check at the DMV..

 

CANCELLATION: If you need to cancel or reschedule a Behind-The-Wheel lesson, we require at least 24 hours’ notice over the phone or through your online student portal. E-mail and voicemail cancellations are not accepted. Last-minute cancellations or no-shows for Behind-The-Wheel Lessons and tests are subject to a $60/2 hours fee.

 

REFUNDS AND OTHER FEES: If for any reason you need a refund, a 30% processing fee will be assessed to the amount refunded. Refunds are only distributed to those with credit less than 30 days old. All debit/credit payment transactions are also subject to a 3% processing fee.

 

VALIDITY AND TRANSFER: Students will have 9 months from the start of their classroom course (or purchase date if only driving lessons are purchased) to complete both their classroom and driving requirements for Driver's Education. After these 9 months, your credit will expire and your teen student will have to re-register and begin the program again. If for any reason, your teen is dropped from a class and needs to re-enroll in another one, there is a $45 reenrollment fee, if the teen is re-enrolled before the credit expiry date.   All other Program Credit is valid for 9 months from the purchase date. When this period is over, the credit will expire. This credit is transferable to other students before it expires.

 

INSTRUCTION MOTORCYCLE PERMIT AND REGULAR DRIVER'S LICENSE: Each student must have a valid Motorcycle Permit and a Valid Regular Driver’s License in his/her possession when engaged in motorcycle operation. If you do not bring any of the aforementioned documents, we will cancel your class and a cancellation fee will be assessed. Riding exercise cancellation fee: $120 Road test cancellation fee: $60. All fees must be paid for students to re-schedule classes.

 

CANCELLATION NOTICE: All cancellations of riding lessons must be made at least 72 hours in advance of the lesson’s start time. Students who do not cancel their lessons or Road Test at least 72 hours in advance will be charged a $90 cancellation fee for Riding practice or $60 Road Test in order to reschedule the lesson on an upcoming session. Cancellations can be made by speaking directly to a member of the office on the phone. Text messages, emails, or voicemails left for Nova staff are not sufficient notice, and are not accepted as cancellation notifications. A 30% processing fee will also be charged on any scheduled lessons or packages that are not taken because the student decides to withdraw enrollment from Nova Driving School prior to taking the lesson.

 

RIDING GEAR: Students must wear a helmet during the lessons, if you does not you’re your own DOT (Department of Transportation) approved helmet, NDS will provide you with one. A bandana is required for more comfort in your helmet. If you want to wear glasses for eye protection, this must have plastic lenses. Long sleeve shirt, full fingered motorcycle gloves, Full Length Denim or Heavy Canvas Pants and Over-The-Ankle Boots with rubber soles (also shoes that covers your ankles), are required for the riding exercises and the Road test. If the student fails to meet these requirements, the day of the riding practice, the lesson(s) will be recorded as cancelled, and a $120 cancellation fee will be incurred. If the student fails to meet these requirements on the day of the Road Test, $60 cancelation fee will apply.

 

ROAD TEST AT SECRETARY OF STATE’S OFFICE: A brief practice is allotted prior the road test. It will be under the discretion of the instructor to decide if you meet the skills and safety requirements for you to take the RT. Road Test may be subject to cancellation due to weather conditions.

 

NOT READY FOR ROAD TEST: If the student is not ready for the Motorcycle Road Test after the riding exercise, student will have the option to upgrade the program to have extra practice or reschedule the Road Test with a $60 cancellation fee. Nova is not responsible for any student who failed the Road test.

 

By signing this Form, you are irrevocably giving permission to the Nova Driving School, its officers, agents, employees, successors, licensees, and assigns to use the image, likeness, appearance, video or sound recordings of your child for safety and quality control purposes.

Your consent to the use of video and sound recordings and your child's image, likeness, appearance, and voice now or in the future. The video and sound recordings may be used for any educational, training or informational purposes whatsoever, but not for any commercial uses. Nova Driving School will only share the image, likeness, appearance, video and sound recordings with its agents, employees, successors, licensees, and assigns. All rights, title and interest in the image, likeness, appearance, video and sound recordings belong solely to Nova Driving School.

I understand and agree to the conditions outlined in this video and sound recording release and consent form. As the parent or legal guardian of the participant named below and on behalf of my child, I irrevocably give consent to Nova Driving School, it's officers, agent, employees, successors, licensees, and assigns forever to make use of my child's image, likeness, appearance, and voice in video and sound recordings as described above. I acknowledge that I am fully aware of the contents of this release and am under no disability, duress or undue influence at the time of my signing of this instrument.

By Signing up with Nova Driving School (2036 N. Western Ave. Chicago, Illinois. 60646), I certify that I have read the entire Information, Agreement, and Terms & Conditions Forms (available upon request or online at https://www.novadriving.com), and myself and my son/daughter agree to the policies, terms, and conditions detailed within. I hereby enroll my son/daughter in NDS’ Teen Driver’s Education Program. I authorize my son/daughter to attend NDS’ classroom instruction and to provide my son/daughter with supervised, practical behind the wheel instruction in automobiles owned or leased by them on city streets and state highways as they deem appropriate for the purposes of driver’s education. I also authorize my son/daughter to schedule lessons on their behalf, if I am not able to. I understand I may retain a copy of these forms for my records, may ask for additional copies, and can view the Terms & Conditions on the NDS Website (https://www.novadriving.com) at any time.
