TERMS AND CONDITIONS



BEHIND-THE-WHEEL PROCEDURE: Nova Driving School follows a Behind-The-Wheel curriculum that covers all driving techniques needed for safe and defensive driving on Illinois roads. At minimum, a student will be considered ready for their road test if they demonstrate adequate skill in all required techniques on the Illinois Road Test. Instructors advance through the curriculum at their discretion, and students may not request to start later in the curriculum, despite any assumed previous experience, unless the student has a valid Illinois Driver's License.

 

CANCELLATION NOTICE FOR DRIVING: All cancellations of driving lessons must be made at least 24 hours in advance of the lesson’s start time. Students who do not cancel their lessons at least 24 hours in advance will be charged a $60 cancellation fee per every two hours scheduled. Cancellations can be made via the student’s Nova web portal account (for which all students receive a login and password when they first sign up for classes with Nova), or by speaking directly to a member of the office on the phone. Text messages, emails, or voicemails left for Nova staff are not sufficient notice, and are not accepted as cancellation notifications. Should a student request to end a lesson early, the remaining lesson time will be considered forfeit, and additional hours can be purchased.

 

All canceled lessons must be rescheduled for the student to complete the required driving time mandated by Secretary of State.

 

NOT READY FOR ROAD TEST: If the instructor feels that you are not ready for the Road Test (RT), the test will be cancelled with a $60 fee and rescheduled for a different day.

 

INSTRUCTION PERMIT: Students must have a valid driver’s instruction permit (original, no copies) with them any time they intend to drive a vehicle. If a student does not have their permit with them on a lesson day, the lesson will be cancelled and a $60 rescheduling fee will apply.

 

FOOTWEAR POLICY: Students may not wear sandals, Crocs, or open-toed shoes of any kind during driving lessons. Shoes must cover both the toes and the heels of the student. No high heels of any kind are permitted during Behind-the-Wheel lessons. If the student fails to meet these requirements, the lesson(s) will be recorded as cancelled, and a $60 cancellation fee will be incurred.

 

ROAD TEST AT SECRETARY OF STATE’S OFFICE: NDS will assist students in scheduling the road test appointment at the Secretary of State DMV. Note that availability on a first-come first-serve basis and fluctuate depending on DMV staff coverage, and can only be scheduled on the morning of. NDS is not responsible if an appointment can not be secured on any given day, but rescheduling for a different date will be offered free of charge. Students should wait at home until NDS staff contacts them with an appointment time. Transportation to and/or from the DMV is not offered by NDS - it is the student's responsibility to make it to the DMV in a timely manner.

 

Two hours are allotted, from the time of the appointment, to wait for and take the road test. Any additional time spent at the Secretary of State due to tardiness or other factors, including the need to resolve documentation, eligibility, or license issues will be charged at a rate of $55/hour. It is the student's responsibility to bring all necessary documentation to obtain an Illinois Driver's License, and NDS is not responsible for a student's inadequate paperwork. Students can choose to reschedule the road test for another day in order to resolve any issues preventing them from taking the test, but they will owe Nova a $60 rescheduling fee.

 

STUDENT CONDUCT: The instructor reserves the right to cancel/stop a driving lesson or remove a student from class, if a student fails to follow our Behind-The-Wheel and classroom policies, including but not limited to: not carrying an Instruction Permit, not wearing proper closed-toe footwear, hygiene, cell phone use and not setting them to silent/off, misconduct or improper/dangerous behavior, and refusal to comply with warnings about said behavior. Lessons will also be cancelled if the student is found to be unfit for driving, such as being under the influence or drowsy.

 

If the instructor decides to stop a driving lesson for the aforementioned reasons, Nova will consider that lesson as fulfilled. The student will not owe a cancellation fee, but will not receive a refund for the lesson.

 

LESSON FEEDBACK POLICY: We strive to provide each student with the best possible experience. If you are dissatisfied with any aspect of your lessons, we want to hear about it. Please contact Nova and let us know right away, as each in-car lesson's video recording is only available for review for 30 days. If you contact us more than 30 days after the lesson in question, we will not have any access to the in-car video recording.

 

CLASSROOM PROGRAM PROCEDURE

 

INDEPENDENT CLASSROOM SESSIONS: Must be canceled at least 48 hours in advance via phone call only (no emails/voicemails). Last-minute cancellations or no-shows for Independent classroom sessions are subject to a $90/2 hours fee.

STUDENT CONDUCT: The instructor reserves the right to cancel a lesson or remove a student from class, if a student fails to follow our Behind-The-Wheel and classroom policies, including but not limited to: not carrying an Instruction Permit, not wearing proper closed-toe footwear, hygiene, COVID-19 precautions, misconduct or improper behavior.

 

OTHER POLICIES

REFUNDS AND OTHER FEES: If for any reason you need a refund, a 30% processing fee will be assessed to the amount refunded. Refunds are only distributed to those with credit less than 30 days old. All debit/credit payment transactions are also subject to a 4% processing fee.

 

VALIDITY AND TRANSFER: Students will have 9 months from the start of their classroom course (or purchase date if only driving lessons are purchased) to complete both their classroom and driving requirements for Driver's Education. After these 9 months, your credit will expire and your teen student will have to re-register and begin the program again. If for any reason, your teen is dropped from a class and needs to re-enroll in another one, there is a $60 reenrollment fee, if the teen is re-enrolled before the credit expiry date.

 

All other Program Credit is valid for 9 months from the purchase date. When this period is over, the credit will expire. This credit is transferable to other students before it expires.

TEEN CERTIFICATION/ELIGIBILITY: To be eligible to earn their driver’s license before they turn 18, teens residing in Illinois must complete a 30-hour classroom course as well as a Behind-the-Wheel course. Teens may be eligible for classroom instruction if the class program ends after the student turns 15 years of age.

Students will be eligible to take the Illinois Written Exam to obtain their Illinois Class D Permit after the fourth day of class. The following documents must be turned in before the conclusion of a complete program, or certification will not be sent to the Secretary of State:

Behind-The-Wheel Only students (BTW-Only) will, in addition to the above documents, also need to provide proof of completion of the classroom portion of Driver's Ed, or certification will not be sent to the Secretary of State. If the students are interested in the Teen Road Evaluation, this proof must also show a letter grade of A or B.

 

After completion of their Behind-The-Wheel program, students must wait for a certificate from the Secretary of State, sent via postage mail, before they may visit the DMV to take their road test (provided that they are eligible, as detailed below).

Nova Driving School applies to the Secretary of State for the teen to receive full certification for completing Driver’s Ed when the following criteria have been met:

  1. 1. The teen has completed all required classroom and in-vehicle training.
  2. 2. All required documents are submitted to Nova Driving.

To obtain a Class D Illinois Driver’s License, a teen must meet the previous two criteria, in addition to:

  • - be at least 16 years of age
  • - have held an Instruction Permit for at least 9 months
  • - has fulfilled the 50-hour log sheet with at least 50 hours of Behind-The-Wheel practice recorded.
 

These Driver's Education requirements are meant to satisfy only the requirements listed by the Illinois Secretary of State. Parents who wish to transfer completion records to other States must note that that process is completely at the discretion of that state's Secretary of State.

 

TEEN ABSENCE/MAKEUP POLICY: A maximum of four absences are allowed throughout the teen classroom program. Students who arrive more than 15 minutes late after class start can be marked as absent, at instructor discretion. Missed classes must be made up before the conclusion of the program – public self-study makeup sessions are held every Friday, anytime between 4:30p-6:30p, unless otherwise stated or arranged. Missing the fifth class will result in your teen being dropped from the program. You may re-enroll in another class for a $60 re-enrollment fee, provided that your credit is still valid.

TEEN SCHEDULING BEHIND-THE-WHEEL (BTW) LESSONS: Your teen may start their BTW Lessons as long as their program is paid in full, and completed copies of the Instruction Permit, School Approval Form, and this Agreement form are turned in to the Nova office. BTW Lessons will not be scheduled until all the above criteria are met. Note that for BTW-only students, proof of classroom driver’s ed completion is also required. Your teen cannot start the classroom lesson without a signed copy of the terms and conditions.

 

TEEN PERMIT CHAPERONE POLICIES: Parents/Guardians who enroll their teen students for the Chaperone program, which offers scheduling/transportation assistance for the permit exam at the DMV, agree to the following policies

  • Students must have all documents on the day of their appointment (a list of all possible documents to bring can be found here), including their permit application form from Nova, filled out and signed by a parent in black ink.
  • Students must be eligible for the permit exam - at least 15 years of age, and have completed at least 4 days of the teen driver education program.
  • Seating for the transportation is limited - cancellations made less than 24 hours in advance will result in the credit being forfeited, and an additional program must be purchased to reschedule.
  • If a student does not have the adequate documents or is found to be ineligible to take the trip to the DMV on the day of the appointment, they will be sent home and the credit will be considered forfeit.
  • If a student fails the exam, the credit will be considered completed and an additional program will have to be purchased if the student wishes to go again.
  • Students that cannot go due to a lack of DMV appointment availability will be rescheduled by Nova for the next Chaperone program date.

    TEEN ROAD EVALUATION POLICY: Students who have completed the classroom and range requirements for Driver's Ed, with a final classroom grade of B or higher, qualify for taking a Road Evaluation at Nova. If you have completed Driver's Education elsewhere, a copy of the permit and proof of classroom completion is required to register for the Teen Road Evaluation.

      Students who pass the evaluation at Nova are issued a certificate that they may use, after fulfilling the time and 50-hour requirements, at the DMV to obtain their Driver's License. The certificate replaces the need for taking the test again at the DMV. Students who undertake the Teen Road Evaluation at Nova are subject to a spot check at the DMV.

    PERSONAL PROPERTY: The staff and instructors at Nova Driving School are not liable for loss of a student’s private property and/or documents. Please keep track of your belongings when in a Nova classroom or car.

If for any reason, your teen is dropped from a class and needs to re-enroll in another one, there is a $60 reenrollment fee, if the teen is re-enrolled before the credit expiry date.in progress due to a lack of adequate footwear, the student’s cognitive impairment, or failure to follow directions. Nova will consider that lesson as fulfilled.

     

    Any act of violence toward the instructor or vehicle will be considered an act of crime wherein the authorities will be notified. Nova will consider that lesson as fulfilled and students will be banned from our services at Nova Driving School.

     

    The student will not owe a cancellation fee, but will not receive a refund for the lesson. Credit for driving lessons is valid for nine months from the purchase date. If nine months pass before the student makes up the lesson, they will have to pay full price for any additional driving lessons.

     

    VALIDITY AND TRANSFER: Students will have 9 months from the start of their classroom course to complete both their classroom and driving requirements for Driver's Education.     INSTRUCTION MOTORCYCLE PERMIT AND REGULAR DRIVER'S LICENSE: Each student must have a valid Motorcycle Permit and a Valid Regular Driver’s License in his/her possession when engaged in motorcycle operation. If you do not bring any of the aforementioned documents, we will cancel your class and a cancellation fee will be assessed. Riding exercise cancellation fee: $120 Road test cancellation fee: $60. All fees must be paid for students to re-schedule classes.

     

    CANCELLATION NOTICE: All cancellations of riding lessons must be made at least 72 hours in advance of the lesson’s start time. Students who do not cancel their lessons or Road Test at least 72 hours in advance will be charged a $90 cancellation fee for Riding practice or $60 Road Test in order to reschedule the lesson on an upcoming session. Cancellations can be made by speaking directly to a member of the office on the phone. Text messages, emails, or voicemails left for Nova staff are not sufficient notice, and are not accepted as cancellation notifications. A 30% processing fee will also be charged on any scheduled lessons or packages that are not taken because the student decides to withdraw enrollment from Nova Driving School prior to taking the lesson.

     

    RIDING GEAR: Students must wear a helmet during the lessons, if you does not you’re your own DOT (Department of Transportation) approved helmet, NDS will provide you with one. A bandana is required for more comfort in your helmet. If you want to wear glasses for eye protection, this must have plastic lenses. Long sleeve shirt, full fingered motorcycle gloves, Full Length Denim or Heavy Canvas Pants and Over-The-Ankle Boots with rubber soles (also shoes that covers your ankles), are required for the riding exercises and the Road test. If the student fails to meet these requirements, the day of the riding practice, the lesson(s) will be recorded as cancelled, and a $120 cancellation fee will be incurred. If the student fails to meet these requirements on the day of the Road Test, $60 cancelation fee will apply.

     

    ROAD TEST AT SECRETARY OF STATE’S OFFICE: A brief practice is allotted prior the road test. It will be under the discretion of the instructor to decide if you meet the skills and safety requirements for you to take the RT. Road Test may be subject to cancellation due to weather conditions.

     

    NOT READY FOR ROAD TEST: If the student is not ready for the Motorcycle Road Test after the riding exercise, student will have the option to upgrade the program to have extra practice or reschedule the Road Test with a $60 cancellation fee. Nova is not responsible for any student who failed the Road test.

     

    By signing this Form, you are irrevocably giving permission to the Nova Driving School, its officers, agents, employees, successors, licensees, and assigns to use your image, likeness, appearance, video or sound recordings for your teen's safety and quality control purposes. The video and sound recordings may be used for any educational, training, promotional, or informational purposes whatsoever, but not for any commercial uses. Nova Driving School will only share the image, likeness, appearance, video and sound recordings with its agents, employees, successors, licensees, and assigns. All rights, title and interest in the image, likeness, appearance, video and sound recordings belong solely to Nova Driving School.

     

    You (parent) have signed your son/daughter up for the Teen Driver’s Ed Program, to prepare them for obtaining an Illinois Driver’s License. All techniques and materials are the exclusive property of Nova Driving School (“NDS”). You agree not to disclose, sell or distribute any information, written or spoken, obtained from NDS, to any third party.

     

    NDS may, at its own discretion, change course schedules and locations and, on rare occasions, cancel a course if there is not a minimum of 7 students enrolled. You understand that course size is limited and therefore enrollment is taken on a first-come, first-serve basis. NDS may dismiss any student who has not paid tuition, in full, in accordance with our tuition policies or who, in NDS’s opinion, has a disruptive attitude or poor hygiene during classroom and/or driving lessons, or refuses to comply with in-class/in-car conduct policies.

     

    By Signing up with Nova Driving School, I certify that I have read the entire Information, Agreement, and Terms & Conditions Forms (available upon request or online at https://www.novadriving.com), and myself and my son/daughter agree to the policies, terms, and conditions detailed within (including the ones detailed on the back of this agreement form) I hereby enroll my son/daughter in NDS’ Teen Driver’s Education Program. I authorize my son/daughter to attend NDS’ classroom instruction and to provide my son/daughter with supervised, practical behind the wheel instruction in automobiles owned or leased by them on city streets and state highways as they deem appropriate for the purposes of driver’s education. I also authorize my son/daughter to schedule lessons on their behalf, if I am not able to. I also authorize my teen to participate in a Teen Road Evaluation, if such a program is purchased and my son/daughter qualifies for Nova to administer the Road Test. I understand I may retain a copy of these forms for my records, may ask for additional copies, and can view the Terms & Conditions on the NDS Website (https://www.novadriving.com) at any time.

     

    By Signing up with Nova Driving School (2036 N. Western Ave. Chicago, Illinois. 60646), I certify that I have read the entire Information, Agreement, and Terms & Conditions Forms (available upon request or online at https://www.novadriving.com), and I agree to the policies, terms, and conditions detailed within. I understand I may retain a copy of these forms for my records, may ask for additional copies, and can view the Terms & Conditions on the NDS Website (https://www.novadriving.com) at any time.

     

    By checking the above Box, you acknowledge that Nova Driving School ("NDS") has a six-hour Adult Driver Education ("ADE") course meant to prepare new drivers for going on the road for the first time, even for older adult drivers. The course is mandatory for those who are 17 years and 3 months of age, to 20 years of age, who have not completed a driver education course in high school. This course is recommended for those 21 or over, prior to obtaining their permit/license.

      Furthermore, by checking the above box, one of the following statements applies to you:
  • You are between the ages of 17y 3mo - 20 years old and are enrolled in the ADE class at NDS.
  • You are between the ages of 17y 3mo - 20 years old and have completed either the ADE course or the 30-hour Teenage Driver Education course (and can provide physical proof)
  • You are over 21 and are enrolled in the ADE course.
  • You are over 21 and have declined to take the ADE course.

    The following are Nova Driving School’s (“NDS,” “Nova”) General Terms and Conditions. These terms and conditions apply to all students in all classes. This agreement constitutes all policies agreed upon by registered NDS students. Please read this page carefully.

     

    COVID-19 PRECAUTIONS: Nova Driving School is committed to the safety and well-being of its students and staff. The following guidelines are in place:

     
    • • Classroom lessons will be in a mask-optional environment.
    • • Office/school spaces will be a mask-optional environment.
    • • Behind-The-wheel lessons will be in a mask-optional environment but are strongly recommended. Prior to the lesson, driving instructors and students should agree on whether or not to wear a mask.
    • • We, however, still highly recommend that anyone who is NOT VACCINATED wears a mask.
    • • We will no longer conduct contact tracing at school and we’ll no longer exclude students & staff who have been in close contact with a person who tested positive for Covid 19.

    Please note of the mitigation strategies that are still in place:

  • Students who are sick SHOULD NOT attend any class nor driving lessons.
  • Students and Staff Members who have tested positive for COVID-19 should not come to Nova for at least 5 days. If after 5 days, a student or staff still has a fever or symptoms are still present, they should continue to STAY AT HOME.
  • A student or staff member may only return to Nova once fever and all symptoms are gone or have at least diminished. Returning students and staff who recently tested positive for COVID-19 should wear a mask 6-10 days after they were tested.
  • If a student needs to cancel last-minute due to a positive COVID-19 case, the cancellation fee may, at NDS’ discretion, be waived if a copy of a positive test result is submitted to NDS. A negative test result must then be submitted prior to rescheduling lessons.
  • NDS may, at the direction of the State, cancel all upcoming driving lessons, in accordance to the State of Illinois' Restore Illinois/COVID-19 policies.
  •  

    INTELLECTUAL PROPERTY: All techniques and materials are the exclusive property of Nova Driving School (“NDS”). You agree not to disclose, sell or distribute any information, written or spoken, obtained from NDS, to any third party.

     

    STUDENT DISMISSAL AND SCHEDULING: NDS may, at its own discretion, change course schedules and locations and, on rare occasions, cancel a course if there is not a minimum of 7 students enrolled. In the case of Motorcycle Programs, Riding Practice and Road Test can also get cancelled due to weather conditions. You understand that course size is limited and therefore enrollment is taken on a first-come, first-serve basis. NDS may dismiss any student who has not paid tuition, in full, in accordance with our tuition policies or who, in NDS’s opinion, has a disruptive attitude or smell during classroom and/or driving lessons, or refuses to comply with in-class/in-car conduct policies. .

     

    CONFIDENTIALITY: NDS will not disclose, sell, or distribute any information obtained from a student, either written or spoken, with any third party, unless it is requested to do so by legal party or court order. The student agrees not to copy, reproduce, download, upload, post, display, broadcast, transmit, distribute, publish, republish, encode, translate or otherwise use any Materials or Marks provided on this website in any form, by any means, in any medium, or by any information storage or retrieval system without the express written permission of NDS.

     

    WEBSITE: Both NovaDrivingSchool.com and NovaDriving.com make use of marketing pixels. All trademarks, service marks, logos, model and brand names, emblems and protectable trade dress elements, whether explicitly marked or not, (individually and collectively, “Marks”) used on this website are owned by NDS or joint partners, or are used with permission. All Marks are subject to U.S. (federal and state) and international trademark, unfair competition laws, and other intellectual property laws.

     

    PERSONAL PROPERTY: The staff and instructors at Nova Driving School are not liable for loss of a student’s private property and/or documents. Please keep track of your belongings when in a Nova classroom or car.

     

    DISPUTE RESOLUTION: All disputes under Administrative Driving Code, Title 92, Chap. II, Part 1060.80 shall be directed to the Illinois Secretary of State Office.

    Nova Driving School built the NSD Instructor App as a free app. This SERVICE is provided by Nova Driving School at no cost and is intended for use as is. This page is used to inform visitors regarding our policies with the collection, use, and disclosure of Personal Information if anyone decided to use our Service. If you choose to use our Service, then you agree to the collection and use of information in relation to this policy. The Personal Information that we collect is used for providing and improving the Service. We will not use or share your information with anyone except as described in this Privacy Policy. The terms used in this Privacy Policy have the same meanings as in our Terms and Conditions, which are accessible at NSD Instructor App unless otherwise defined in this Privacy Policy.

    We want to inform you that whenever you use our Service, in the case of an error in the app we collect data and information (through third-party products) on your phone called Log Data.
